Accessory buildings

ACCESSORY BUILDING OR STRUCTURE
A subordinate building or structure, the purpose of which is customarily incidental to that of its principal use or building and on the same lot. Where an accessory building is attached to the side, rear or front of the principal building by a wall or roof, such accessory building shall be considered part of the main building for the purpose of determining the required dimensions of yards.

Districts Where Allowed Districts Permitted by Right: R-1, R-1A, R-1B, R-1C, R-2, R-3

Development Requirements:
An accessory building attached to a principal building shall comply in all respects with the yard requirements of this chapter for the principal building.

Detached accessory buildings shall not exceed 200 square feet and shall be no more than 12 feet in height.

Only two such detached accessory buildings of different types (i.e., shed, gazebo) shall be permitted on each lot.

Detached accessory buildings shall be located to the rear of the rear building line of the principal building and shall conform to the yard requirements of the schedule, § 370-7 of this chapter.

On corner lots, no such structure or building of any kind shall be permitted in the area beyond the sidewall (as extended) of the house nearest the street, except in the case of a property that has been fenced in accordance with § 155-3I.

In no event shall a carport be considered an accessory use. For purposes of this Subsection N and Subsection O, a "carport" shall mean a roofed, wall-less shed projecting from the front or side of a building, used or designed to be used as a shelter for an automobile.

Accessory child-care centers

CHILD-CARE CENTER
An early childhood caregiving facility providing qualified adult supervision for children ranging in age from infants to 13 years of age for six or more children.

ACCESSORY CHILD-CARE CENTERS
Child care provided for children of employees and/or members only, affiliated with the primary use of the property, i.e., professional offices, commercial establishments, churches, etc. Accessory child-care centers are allowed as an accessory use, provided that the child-care facility is located within a building on a lot meeting all the design requirements of the zoning district, and the accessory child-care center facility meets the requirements established for accessory child-care centers.

Districts Where Allowed Districts Allowed as a Conditional Use: A-1, B-1, B-2

Passenger Loading:
An off-street dropoff area, 10 feet by 40 feet, shall be provided. The location of the dropoff area shall be determined by the Board.

Development Requirements:
Standards for accessory child-care centers.

(1) Accessory child-care centers developed within existing buildings and designed to serve the employees or members of the primary use on the lot may be developed on a lot equal to the minimum lot size for the primary use located on the lot, provided that the total floor area ratio of the lot does not exceed chapter requirements for the zoning district.

(2) At the Board's discretion, separate parking facilities and/or dropoff space may be required if the child-care facilities are deemed to be excessively remote from related uses.

(3) Parking. See § 370-88C(3) for detailed information.

(4) An off-street dropoff area. See "Passenger Loading" above for details.

(5) The outdoor play space may not be divided into more than two play areas of equal size, unless distinct, designated areas are designed for separate age groups. Age-appropriate play equipment should be considered if play areas are proposed to be age-specific. All outdoor play areas must be contiguous with the building. All outdoor play areas shall have two means of ingress and egress. One should be secured for emergency access only.

(6) Outdoor play space shall be fenced with a six-foot-high fence, located at least two feet within the property line. The fence shall be landscaped along the outside face as directed by the Board. All parking shall be screened from the outdoor play area.

(7) For sanitary and safety reasons, no animal enclosures, i.e., dog runs, rabbit hutches, etc., shall be located directly within the outdoor play area.

(8) All outdoor play areas, parking and walkways shall be adequately lighted.

(9) Sand shall not be used as a play surface, except within a sandbox.

Development Requirements:
Accessory uses and structures customarily associated with the industrial, research and office uses permitted in this zone, such as employee cafeterias; waiting station shelters for public transportation; showrooms and sales rooms for products packaged, assembled or processed on the site; employee recreation facilities; and other similar facilities for convenience of employees and/or visitors.

Assembly hall

Districts Where Allowed Districts Permitted by Right: B-2, B-3

Vehicle Parking:
B-3 District: one parking space for every 125 square feet of gross floor area or major fraction thereof.
Fixed seating: one parking space for every four seats in the main assembly unit.
No fixed seating: one parking space for every four persons who may legally be admitted therein at one time under the state fire prevention laws.

Development Requirements:
With the approval from the Planning Board and all of which can be carried on within a building.

Banquet facilities

Any establishment, however designated, regularly and principally used for the purpose of providing meals for banquets and catered events, having an adequate kitchen and facilities for the preparing, cooking and serving of food for its patrons and in which alcoholic beverages are sold for consumption on the premises in conjunction with a banquet function or the serving of a full meal. Banquet facilities are permitted only in the B-1 Primary Business District or as part of a regulation eighteen-hole golf course and must provide seating for not less than 150 patrons.

Districts Where Allowed Districts Permitted by Right: R-1, R-2, R-3

Development Requirements:
(1) Except as hereinafter provided, no open storage of boats and boat trailers or camping or travel trailers shall be permitted, except:

(a) On the paved portion of the front yard.
(b) In the side yard in accordance with § 370-75J.
(c) In the case of boats and boat trailers, in the rear yard of premises having direct rear yard access to the Rancocas Creek.

(2) Motor vehicles may be stored only upon off-street parking areas as defined in § 370-76A.

(3) The storage of boats and boat trailers or camping or travel trailers shall be permitted in the rear yard upon the obtaining of a permit therefor and compliance with each of the following conditions:

(a) The stored boat and boat trailer or camping or travel trailer shall be parked no closer than four feet to the side and rear property lines, and, in the case of reverse frontage lots, not less than 24 feet from the rear property lines and not closer than 10 feet from the living area of any adjacent house.

(b) The area of ground coverage encompassed by the parked or stored boat and boat trailer or camping or travel trailer combined with the area of all existing buildings on the property shall not exceed the maximum percentage of a lot to be occupied by buildings or structures as set forth in this section.

(c) No boat and boat trailer or camping or travel trailer shall be parked or stored unless it is in condition for safe and effective performance of the function for which it is intended or can be made so at a cost not exceeding the value of the boat and boat trailer or camping or travel trailer in its existing state. In no case shall any such boat and boat trailer or camping or travel trailer be so parked or stored for a period of more than two months if not in condition for safe and effective performance of the function for which it is intended.

(d) Each occupied single-family residential property may have outside parking or storage upon it for one boat and boat trailer or camping or travel trailer. "Outside parking" shall be parking not enclosed within four walls.

(e) The boat and boat trailer or camping or travel trailer shall have and display thereon a current state license or registration.

(f) The boat and boat trailer or camping or travel trailer parked or stored shall not be occupied for living or sleeping purposes and shall not have connection to electricity, water, gas or sanitary sewer facilities for the purpose of using this equipment for living or householding purposes within the Township.

(g) Motors or engines that are a part of or attached to or used with the equipment shall not be worked on or tested in such a manner as to annoy and disturb adjacent property owners or occupants, and, specifically, motors or engines shall not be worked on or tested before 9:00 a.m. or after 7:30 p.m., prevailing time, on Monday through Saturday, inclusive, or before 10:00 a.m. or after 7:30 p.m., prevailing time, on Sunday. Testing of the motors or engines shall not be permitted for more than one hour during any day of the week and for more than 15 minutes consecutively at any time during the day. Testing shall be further subject to Chapter 231, Noise, of the Code of the Township of Willingboro, pertaining to regulation of noise.

(h) The boat and boat trailer or camping or travel trailer shall be screened from any adjacent residential structure by a living fence, which shall have a minimum height of four feet, where the parked or stored equipment is within 70 feet of an adjacent residential structure, and access to the parked or stored equipment to the street shall not be through the rear or side yard reverse planting areas.

(i) The exterior parking and storage area shall be maintained in a clean and sanitary condition, free from any accumulation of garbage or rubbish. The repair and maintenance functions contained herein shall be performed in such a manner as to keep the premises free from rodents, vermin and insects.

(j) Where the rear yard is also adjacent to a street on the side, parking or storage shall not be permitted in the rear yard in an area extending beyond the side of the dwelling closest to such street.

Churches, synagogues or other places of worship

A building or group of buildings, including customary accessory buildings, designed or intended for public worship. For the purpose of this chapter, the word "church" shall include chapels, congregations, cathedrals, temples and similar designations, as well as parish houses, convents and similar places of residences for members of the clergy and religious orders.

Districts Where Allowed Districts Permitted by Right: A-1, R-1, R-1A, R-1B, R-1C, R-2, R-3

Vehicle Parking:
One parking space for every four seats in the main assembly unit.

Development Requirements:
Churches, synagogues, or other places of worship are specifically prohibited in the B-1 Zoning District from the Willingboro Township-Burlington Township line south to the intersection of Rose Street and U.S. Route 130. That area is designated for business and commercial development and those uses specifically permitted in the B-1 Zoning District. Churches, synagogues, or other places of worship may be permitted in any residential district and in the B-1 District south of Rose Street, provided the following standards are strictly observed:

No building, structure, or facility shall be located within 20 feet of an adjacent residential lot.

Parking shall be provided as required in § 370-76C of this chapter.

Cluster developments

CLUSTER DWELLING
One of a series of detached one-family dwelling units in which all plotted lots may be reduced in size and lot width and which may be grouped or clustered together in a compact service area separated by open space areas which may be dedicated to the Township for public use or held for private recreation purposes as outlined in Article VIII, R-2 Residential District, of this chapter.

Districts Where Allowed Districts Permitted by Right: R-2, R-3

Development Requirements:
R-2 District:
Cluster developments of one-family detached dwellings, subject to the following provisions:

(1) All lots shall have a minimum area of 8,000 square feet each.
(2) The maximum number of lots per gross acre shall not exceed 2.9.
(3) Interior lots shall not have a minimum width, but a minimum side yard of seven feet on one side and a total minimum of 15 feet for both side yards shall be required.
(4) Corner lots shall have a minimum side yard of eight feet on one side and a total minimum of 20 feet for both side yards.
(5) The land to be subdivided shall involve the creation of not less than 100 lots.
(6) The land to be saved by clustering shall be devoted to one or more of the following uses:

(a) Open space areas, which must be designated for conveyance to the Township of Willingboro or other appropriate governmental agency and may include land for the following uses:

[1] Municipal parks and playgrounds.
[2] Woodland conservation areas.
[3] Pedestrian walkways.
[4] Stream courses and drainage control areas.
[5] Land for public educational institutions beyond the elementary level.

(b) Private recreation facilities:

[1] Golf courses and country clubs.
[2] Private swimming pools and private swimming clubs.
[3] Marinas.
[4] Tennis courts.
[5] Other recreational facilities, including landscaped and wooded conservation areas.

R-3 District:
Cluster developments of one-family detached dwellings, subject to the following provisions:

(1) All lots shall have a minimum area of 8,000 square feet each.
(2) The maximum number of lots per gross acre shall not exceed 2.5.
(3) Interior lots shall not have a minimum width, but a minimum side yard of seven feet on one side and a total minimum of 15 feet for both side yards shall be required.
(4) Corner lots shall have a minimum side yard of eight feet on one side and a total minimum of 20 feet for both side yards.
(5) The land to be subdivided shall involve the creation of not less than 100 lots.
(6) The land to be saved by clustering shall be devoted to one or more of the following uses:

(a) Open space areas, which must be designated for conveyance to the Township of Willingboro or other appropriate governmental agency and may include land for the following uses:

[1] Municipal parks and playgrounds.
[2] Woodland conservation.
[3] Pedestrian walkways.
[4] Stream courses and drainage control areas.
[5] Land for public educational institutions beyond the elementary level.

(b) Private recreation facilities:

[1] Golf courses and country clubs.
[2] Private swimming pools and private swimming clubs.
[3] Marinas.
[4] Tennis courts.
[5] Other recreational facilities deemed appropriate by the Township Planning Board.

Commercial child-care centers

CHILD-CARE CENTER
An early childhood caregiving facility providing qualified adult supervision for children ranging in age from infants to 13 years of age for six or more children.

COMMERCIAL CHILD-CARE CENTERS
Child care provided within a facility designed to function primarily for the provision of child care. Any child-care center which is not limited to the children of employees and/or members affiliated with the primary use on the lot shall be classified as a commercial child-care center.

Districts Where Allowed Districts Allowed as a Conditional Use: A-1, B-1, B-2

Vehicle Parking:
Off-street parking shall be provided in accordance with the site plan approved by the Board.

Passenger Loading:
An off-street dropoff area, 10 feet by 40 feet, shall be provided. The location of the dropoff area shall be determined by the Board.

Development Requirements:
A. Findings and policy.

(1) Recognizing the need for reasonable child-care opportunities within the Township of Willingboro and due to the expanding nature of regulated child-care facilities, child-care centers shall be classified in two categories: commercial child-care centers and accessory child-care centers.

(2) All child-care centers shall require a site plan review.

B. Standards for commercial child-care centers.

(1) Commercial child-care centers shall be permitted on one-and-one-half-acre or greater lots.

(2) Parking. See "Vehicle Parking" above for details.

(3) An off-street dropoff area. See "Passenger Loading" for details.

(4) The outdoor play space may not be divided into more than two play areas of equal size, unless distinct, designated areas are designed for separate age groups. All outdoor play areas shall have two means of ingress and egress. One should be secured for emergency access only.

Development Requirements:
A. With the application to the Planning Board, the applicant shall submit:

(1) Detailed site and drainage plans, drawn to scale, and accurate boundaries of the tract.
(2) All applicable dimensions set forth in the schedule, § 370-7 of this chapter.
(3) All streets and easements.
(4) Parking and vehicular circulation; the relationship of the proposed use to highways, streets and adjacent properties.
(5) Landscaped areas, existing and proposed.
(6) Drainage.
(7) The location of existing or proposed structures within the tract and within 100 feet of the tract.

B. No such conditional use shall be permitted unless the Planning Board shall determine that:

(1) The proposed use in a specific location is necessary and convenient for the efficient parking and storage of vehicles, trucks, boats and nonmotorized trailers and will in no way detract from the character of the neighborhood or area in which the use is to be located.

(2) Adequate and attractive fences and other safety devices will be provided. All fences shall comply with the provisions of Chapter 155, Fences, of the Code of the Township of Willingboro and the Willingboro Township Fence Construction Code.

(3) Sufficient landscaping, including trees and shrubs, will be provided and periodically maintained.

(4) The parking and storage area or areas will be provided with either a gravel, crushed stone or all-weather pavement and suitable nightlighting facilities shielded from view from adjoining streets and residential areas.

(5) Parking and storage of all vehicles, trucks, boats and nonmotorized trailers will be limited to those licensed or registered and in good repair.

(6) The minimum lot area for a commercial parking or storage area shall be two acres.

(7) No driveway shall open onto a public street or road within 150 feet of an intersection of such street or road with another public street or road. In determining the suitability of proposed or existing driveways upon the site, the Board shall consider such factors as grade and site clearance; the number and pattern of driveways; the number, location and design of ingress and egress points; the volume of traffic which may be anticipated on the site and adjoining roads; and the condition and width of pavement of adjoining roads.

Comprising of any of the following: baby carriages, bicycles, and other similar vehicles; metal, foil, tin, aluminum, gold, etc.; metal furniture; musical instruments; sheet-metal products; and toys.

Any wall, barrier, fence or structure (not including freestanding plants, trees or buildings) which encloses any part of a lot or which divides or separates any lot or part thereof from any part of such lot or from any adjacent private or public property, excepting ornamental corner fences of not more than two sides, no one side of which is longer than 10 feet or higher than three feet.
